PRIVACY & COOKIE POLICY

((in accordance with art.13 Re.UE 2016/679 and the Provision of the Guarantor for the Protection of Personal Data n.229 of 8.05.2014)

Pietranera S.r.l. considers the protection of the personal data of the Users of the website www.pietranera.com  (hereinafter referred to as the ‘Site’) of its own and/or potential customers and of the subjects with whom it has, for various reasons, a contractual relationship, to be of fundamental importance, therefore, by means of this Policy, made pursuant to art. 13 EU Reg. 2016/679 (General Data Protection Regulation), Pietranera S.r.l. has intended to share its policy on the processing of personal data.

1. Data Controller

The Data Controller is Pietranera S.r.l., in the person of its legal representative pro tempore, with registered office in Reggio Emilia (RE), Via Masaccio n.2, P.I.01169000351.

2. Type of data processed by Pietranera S.r.l.

Navigation Data

The computer systems and software procedures used to operate the Site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols (Internet domain and IP protocol, type of browser and operating system of the computer used, date, time and length of stay on the site, pages viewed, any search engine from which you entered the site). Such information is not collected to be associated with identified interested parties, however, by its very nature it could, through processing and association with data held by third parties, allow users to be identified.

This category of data includes the IP addresses or domain names of the computers used by Users who connect to the Site, the URI (Uniform Resource Identifier) notation addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the User's operating system and computer environment. This data is used for the sole purpose of obtaining anonymous statistical information on the use of the Site and will be deleted immediately after processing, without prejudice to the need to ascertain offences by the Judicial Authorities.

Contact requests by Users

In order to be able to validly submit an information request to Pietranera S.r.l. through the contact forms on the Site, i.e. to be able to access the reserved area, the User must enter certain information, falling within the category of common personal data.

Processing of customer and supplier data

The Data Controller guarantees that the data of its own and potential customers and suppliers are processed in full compliance with current legislation on the protection of personal data.


3. Purpose of processing, legal basis and storage period

 

Personal data acquired by Pietranera S.r.l. will be processed by staff expressly authorised and appointed by the Data Controller, in compliance with the principles of correctness, lawfulness, transparency, protection of confidentiality and of the rights of the data subject.

The data provided by Users will be processed for the following purposes:

1. to enable the processing of requests for information and/or formulation of estimates. In this sense, by consenting to the processing of data, the User authorises Pietranera S.r.l. customer care to contact him/her, by telephone and/or e-mail, in order to provide the information requested. This processing is optional and is carried out subject to the User's consent.

 

2. carrying out direct marketing activities: sending newsletters by e-mail and/or paper mail regarding products and services provided by Pietranera S.r.l. This processing is optional and is carried out subject to the User's consent

 

3. allow registration and access to the reserved area of the site and download informative material. This processing is optional and is carried out subject to the User's consent.

 

4. to fulfil any obligations under applicable laws, regulations or EU legislation, or to comply with requests from the authorities

 

It should be noted that, at any time, the User may decide to revoke the consent previously given by forwarding, without any formality, a request to the Data Controller to the contacts indicated at the end of this privacy policy.

Pietranera S.r.l. will process the data of the interested party for the duration strictly necessary to pursue the purposes of the processing, in full compliance with the storage obligations established by law.

If a contractual relationship is established with Pietranera S.r.l. as a result of a request for information/quotations, the data of the customer/supplier if it falls into the category of ‘interested party’, as well as the data, essentially identifying data, of its collaborators, employees and contact persons will be collected and processed pursuant to art. 6 c.1 lett.b) EU Reg. 2016/679 for the purposes of executing pre-contractual measures, for the purposes of executing the contract and for the purposes of managing the contractual relationship. The provision of data by customers and suppliers is mandatory, therefore, the omission, inaccurate or partial provision of data may result in the impossibility of concluding the contractual agreement. Customer and supplier data will be kept for 10 years from the conclusion of the negotiation agreement and subsequently deleted from Pietranera S.r.l. information systems.

Personal data will be processed, at the Data Controller's premises, by means of computerised/telematic or paper-based tools, ensuring the use of appropriate technical and organisational security measures, pursuant to and for the purposes of Art. 32 EU Reg. 2016/679, suitable to reduce the risk of destruction, loss, unauthorised access or processing of personal data that is not permitted or in any case not in accordance with the purposes of its collection.


4. Scope of data communication

 

The personal data provided by the data subjects may be communicated to public, institutional or professional entities authorised by law to request the acquisition thereof as well as, exclusively for the purposes envisaged in art. 3), to third party companies or professionals, which Pietranera S.r.l. uses in the performance of its business activities such as, purely by way of example and not limited to, accounting and tax consultants, legal consultants, third party IT supply and assistance companies. It should be noted that these ‘third parties’, if they do not act as Data Controllers, play the role of Data Processors in accordance with the provisions of Art. 28 of EU Reg. 2016/679 and consequently comply, by virtue of a specific contractual agreement, with the security standards regarding the processing of the data communicated to them. The list of third parties is available upon express request sent to Pietranera S.r.l. at the addresses indicated at the bottom of this privacy policy. It should be noted that, in any case, the personal data of the data subjects are not disseminated or transmitted to third countries (outside the EU).


5. Cookies

Cookies are short text strings (usually in .txt or .xml format) sent by a web server to the User's browser, stored by the latter on the navigation device and automatically re-sent to the server during the same visit to the site (session cookies) or at the next access (persistent cookies). Cookies allow storing information on visitors' preferences in order to improve the functionality of the site and simplify navigation, automating procedures (e.g. login, site language).

According to the characteristics of the cookies it is possible to distinguish

Persistent cookies: these cookies remain stored, until their respective expiry dates, on the user/visitor's device. They are used in order to facilitate navigation within the Site and its proper use, to facilitate access to services that require authentication (avoiding the need for users to re-enter authentication credentials each time they access the services), for statistical purposes, to know which areas of the site have been visited, as well as, in some cases, for optimal management of pages and advertising spaces or to deliver content and advertising in line with the choices made by surfers.

Session cookies: these cookies remain active for the relevant session only, i.e. until the browser is closed. They are used for the purpose of transmitting the session identifiers needed to allow the site to be explored safely and efficiently.

First-party cookies: these can be either persistent or session cookies; they are managed directly by the owner and/or manager of the site and are used, for example, to ensure its technical functioning or to keep track of preferences expressed regarding the use of the site itself.

Third-party cookies: these can also be either persistent or session cookies; they are generated and managed by controllers unrelated to the website visited by the user and are used, for example, to find out the number of pages visited within the website itself (so-called ‘statistical cookies’ or ‘analytics cookies’) or to publish content or advertising on the website you are visiting. Third-party cookies include those relating to external domains such as social plugins from Facebook, Twitter, Google+ and Linkedin. The presence of these plugins involves the transmission of cookies to and from the sites operated by the third parties. According to the main purpose of the cookies, it is possible to distinguish:

Technical cookies: these are used for the sole purpose of ‘carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service’. These cookies do not collect any of the User's personal information, they are necessary for the proper functioning of the Website and functional to ensure normal navigation and use. These cookies are not used for any other purpose and are normally installed directly by the owner or operator of the website. Technical cookies can be subdivided into navigation or session cookies, which guarantee normal navigation and use of the website (allowing, for example, authentication to access reserved areas); analytics cookies, assimilated to technical cookies where they are used directly by the website operator to collect information, in aggregate form, on the number of users and on how they visit the website; functionality cookies, which allow the user to navigate according to a series of selected criteria (for example, language) in order to improve the service rendered to the same. Profiling cookies: these are aimed at creating profiles of the User and are used in order to send advertising messages in line with the preferences expressed by the same while browsing the web. Users' prior consent is required for the installation of such cookies.

This Site only uses third-party technical and analytical cookies (Google Analytics and Facebook Pixel).

The User has the right to deactivate/block cookies by following the instructions provided by the browser (generally found in the ‘Help’, ‘Tools’ or ‘Edit’ menus), it being understood that failure to provide consent/deactivation of technical cookies could compromise access to the Site content.

6. Rights of data subjects

In accordance with the provisions of Articles 15 ff. of EU Reg. 2016/679, at any time the User may exercise towards the Data Controller, his/her rights of:  ‘Right of access’ which allows the data subject to access his/her personal data and obtain a copy of it; “Right of rectification” which allows the data subject to obtain the rectification of his/her data, should the same be inaccurate, or the integration of his/her data, should the same be incomplete; “Right to erasure” which allows the data subject to obtain the erasure of his/her data in the cases provided for by Art. 17 EU Reg. 2016/679; ‘Right to restriction of processing’ which allows the person concerned to obtain the restriction of processing in the cases provided for by art. 18 EU Reg. 2016/679; ‘Right to data portability’ which allows the person concerned to receive in a structured, commonly used and machine-readable format, their personal data as well as to request their transmission, by Pietranera S.r.l., to another Data Controller; ‘Right to object’ which allows the data subject to object, at any time, on grounds relating to his/her personal situation, to the processing of his/her personal data carried out pursuant to Art. 6 c.1 lett. e) or f) EU Reg. 2016/679, as well as to object to the processing of data carried out for direct marketing purposes; ‘Right to lodge a Complaint’ which allows the data subject to lodge a complaint with the Italian Data Protection Authority pursuant to Art. 77 EU Reg. 2016/679.
